A Silicon Valley police task force is investigating the website after the company, roughly valued at £242 billion, claimed the prototype had been stolen.

 

Mr Hogan claimed to have found it on a bar stool in a beer garden after it was left by Robert “Gray†Powell, a 27 year-old Apple software engineer, in a German beer hall in Redwood, San Francisco, near Apple's Cupertino headquarters.

 

Fresh details of the case, which has sparked controversy in America, came after secret witness statements were made public amid heated criticism about police’s handling of the case.

 

Judge Clifford Cretan ordered the documents be made public despite prosecutors arguing such publication would reveal identities of potential witnesses and compromise the investigation.

 

The court documents, disclosed on Friday after applications from local media, give extraordinary insight into Apple's efforts to recover the iPhone prototype, the behind-the-scenes negotiations and the results of the police investigation.

 

Apple jealously guards its unreleased products, particularly the iPhone. Last year Apple made $13 billion from its iPhone, which was almost a third of total company sales.

 

The company traditionally unveils its new iPhones in June, at the Worldwide Developers Conference in San Francisco, and has already released details of iPhone OS 4.0, the next-generation operating system for Apple's range of multimedia devices.

 

According to the documents, after Jobs requested the return of the iPhone to Apple, Mr Lam replied by email that he would give back the device on condition that Apple confirm its authenticity.

 

"I understand the position you're in, and I want to help, but it conflicts with my own responsibilities to give the phone back without any confirmation that it's real, from Apple, officially," Mr Lam emailed to Jobs on April 19.

 

"I want to get this phone back to you ASAP. But I have to get this story of the missing prototype out, and how it was returned to Apple, with some acknowledgment it is Apple's.

 

“Gimzodo lives and dies like many small companies do. When we get a chance to break a story, we have to go with it or we perish.â€

 

After receiving a letter confirming Apple's ownership of the phone, Mr Lam said it could be recovered from Jason Chen, a Gizmodo blogger, who bought it from Mr Hogan.

 

Critics have attacked police after the Mr Chen’s home was controversially raided by members of California's Rapid Enforcement Allied Computer Team.

 

Police seized four computers and two servers along with cameras and an iPhone using a warrant issued by a Superior Court judge (which Gizmodo later published on its website), on suspicion the property was "used as the means of committing a felony".

 

The case has raised concerns about the close ties between the industry and the little-known task force that was created to fight crimes against technology companies.

 

Apple is a member of the technology crime task force's board but the company said it didn't use its influence to pressure it to investigate.

 

Gawker Media is challenging the taking of Chen’s equipment, citing "shield laws" that protect online journalists from having newsroom equipment seized.

 

The documents detail a meeting just days before the raid on Chen’s home, between police and Apple executives, including George Riley, a lawyer acting for the company.

 

"Riley stated the publication of the device and its features is immensely damaging to Apple," Matthew Broad, the detective who led the investigation, wrote.

 

The detective said Apple had told him that "people that would have otherwise purchased a currently existing Apple product would wait for the next item to be released, thereby hurting overall sales and negatively effecting Apple's earningsâ€.

 

"Riley stated that he could not provide an estimated loss, but he believed it was 'huge’. I asked Riley what the value of the missing iPhone was. He stated that it was invaluable," Broad said in an affidavit.

 

Mr Powell told the San Mateo County Sherriff’s Office investigator that he had spent about two hours in the beer garden with his uncle the night the iPhone was lost and left at closing time.

 

Powell said it was possible that the prototype, which had been disguised to resemble a previous model, the iPhone 3GS, fell out of his bag and on to the floor and that it was possible, but unlikely, that it had been stolen.

 

Mr Hogan’s flatmate, Katherine Martinson, contacted the authorities and Apple after she became worried she could be charged in the case because he at one point hooked up the iPhone to her computer, the documents stated.

 

According to the documents, Apple called police after being tipped off by the roommate.

 

Miss Martinson told police how Mr Hogan showed her a camera box containing $5,000 in 100 dollar bills.

 

She told investigators he had tried to interest two other publications, PC World and Engadget, in the iPhone, besides Gizmodo “in an attempt to start bidding for the iPhone prototypeâ€.

 

She told police she and other friends had tried to talk Mr Hogan out of selling the iPhone on the grounds it could ruin Mr Powell's career.

 

"Sucks for him. He lost his phone. Shouldn't have lost his phone," Mr Hogan was quoted as replying.

 

Mr Hogan’s lawyer, Jeffrey Bornstein, said his client continued to cooperate with authorities and had provided evidence to help them.

 

He said his client believed that Gizmodo was compensating him so the blog could review the phone and that there was nothing wrong with sharing the phone with the press.

 

"The events have taken on a life of their own," he said.

 

"He thought it was dumb luck that he stumbled on to something valuable and he regrets not doing more to return it."

 

Apple fell $4.54 to $253.82 during Friday trading on the Nasdaq. The shares have more than doubled in the past year.

 

An Apple spokeswoman said: “We reported what we believe was a crime, and the D.A. of San Mateo county is taking it from there.â€

 

No charges have yet been laid in the case.

Would people currently using the data pack from NTT also be able to use this as well without a separate contract? Or would it have to be "one or the other" (or indeed both).

I was looking at that. I needed to call Docomo anyway so I asked them this morning.

 

Yes!

You will be able to use both devices with the one 定é¡ãƒ‡ãƒ¼ã‚¿ãƒ—ラン data plan - no need for 2 accounts.

You will of course need to put the FOMA card into the gizmo you want to use.

 

So, there will be a way to use the Docomo network. If you don't mind carrying around that small device.

I just though. For me, who already has the Docomo data plan, the only extra cost would be the 500 yen a month (not confirmed) rental of the device).

 

Bargain! I'm looking on the Wifi ipad as a toy to have once again.
