Relief at the side of the road

I'm often borderline shocked at how in the open some old ojisans do their weeing on the side of the road.

One time he was actually pointing towards the road! :lol:

John Pusey and his wife Cherry spent 10 years trying to stop passing motorists using the bottom of their garden as a public convenience.

 

 

But while the high court agreed it was annoying – the judges ruled the "comfort breaks" did not amount to a "nuisance".

 

They rejected the couple's claim to close down the lay-by by the side of the road, leaving them with a six figure legal bill

 

Mr and Mrs Pusey had become so fed up with motorists using the lay-by as a "urinal" that they set up a camera and caught more than 500 people in the act near their farmhouse in Exmoor National Park, near Minehead, Somerset between 2005 and 2010.

 

In addition, they claim they were threatened with a gun whilst investigating a pickup truck parked in the lay-by and assaulted after remonstrating with a driver urinating within sight of the front gate of their home.

 

The lay-by, on the B3224 had become a focus for petty theft, vandalism, fly-tipping and anti-social behaviour, including blaring music, shouting and swearing, they said.

 

Armed with an edited DVD of the evidence the pair tried to get the lay-by closed by the highway authority and when that failed they went to court.

 

They claimed that the regular pit stops interfered with their "reasonable enjoyment" of their home, making it impossible for them to relax in their own house and garden.

 

However, refusing to order Somerset County Council to shut the lay-by, Appeal Court judges ruled that, despite all that the couple had endured, the motorists' misbehaviour did not amount to a "nuisance" in the eyes of the law.
