Then later finds out that the labbly-jabbly is not a real big chest, but artificial. Should she have to pay him when they get divorced because of this. Thats what I'm watching on the TV right now. Siren 0 Posted March 17, 2004 Share Posted March 17, 2004 While the 'shortcoming' complained of may be an important consideration (althought Your Lordships should say at once that the evidence is far from clear), it cannot be said to be the only consideration in the mind of the petitioner at the time of entering into the marriage, which is a form of 'social contract'. In other words, the petitioner has not lost the whole 'bargain'. As such, it is the view of Your Lordships that rescission is not an appropriate remedy and the petition is accordingly dismissed.
